Nancy Jecker’s essay Nothing to be Ashamed of: Sex Robots for Older Adults with Disabilities 1 presents a provocative application of the capabilities approach. Her ethical argument for providing access to sex robots for older adults with disabilities proceeds in five parts: 1. Older adults frequently suffer disabilities that impair sexual functioning. 2. The ability to function sexually is linked to central human capabilities, including: the ability to generate a personally meaningful life narrative; be physically, mentally and emotionally healthy; experience (...) bodily integrity; feel and express a range of human emotions; affiliate deeply with others; and reflect on and choose a plan for their life. 3. Society should take reasonable steps to support these human capabilities at a minimal threshold as part of a broader duty to respect human dignity. 4. Providing access to sex robots comprises part of reasonable efforts to support the six capabilities at a minimal threshold. 5. Therefore, society ought to make reasonable efforts to ensure access to sex robots for older adults with disabilities that impair sexual functioning. I am sympathetic to this line of reasoning, having proposed a series of legal reforms that would facilitate sexual expression among older adults with cognitive impairments as well.2 3 …. (shrink)

This Article uses age as an entry point for examining how temporal and methodological issues in egalitarianism make substantive equality an unattractive goal for vulnerability theory. Instead, vulnerability theory should adopt a continuous doctrine of sufficiency, which is a better fit with vulnerability theory’s underlying aims and rhetoric. Instead of evaluating what individuals have in relation to others, sufficiency refocuses the inquiry on whether we have enough throughout the lifecourse. La fenomenología de Simone de Beauvoir le aplica la diferencia sexual.Esta contribución continúa la hermenéutica de Beauvoir centrándose en su conocida máxima, “no se nace mujer, se llega a serlo”, teniendo en cuenta que las interpretaciones (...) se dan desde y para determinadas situaciones. La nuestra es el siglo XXI y las investigaciones fenomenológicas y feministas. Dado que la traducción es un modo de interpretación, señalaremos cómo El segundo sexo ha contribuido a comprender el devenir mujer. This paper aims to propose an invitation to look at the kind of childhood we have been constructing from the practices of Special Education, in articulation with the practices of Early Childhood Education. It problematizes the discursive webs formed in this articulation, considering the way that Special Education teachers working with Early Childhood in public schools regard childhood. Such discussions have derived from the uneasiness of thinking about how we have been producing childhood, given the policy of expanding mandatory attendance (...) to four-year-old children. The analytical exercise, inspired by the discourse analysis proposed by Michel Foucault, has enabled us to question the production of subjects, truths and realities in the “confessions” of the interviewed teachers, in which we have identified two ways of thinking about and producing childhood: captured childhood, which is produced through the operationalization of normalization practices by Special Education, determined by the will to knowledge and the will to power over childhood; and childhood as heterotopy, produced as a powerful movement of resistance and denaturalization of normalizing practices – childhood regarded from other places, as an infinite, multiple, non-nameable, ever undetermined becoming, as an invitation to thought: what can we do in the encounter with childhood? Background The practice of health advocacy in nursing has been defined as a process aimed at promoting the independence and autonomy of users of health services, in addition to providing information on healthcare decision-making and offering support for decisions taken. Ethical considerations Ethics approval was not required to conduct this review. Aim This integrative review aims to synthesize evidence in the literature on health advocacy in professional nursing practice. Methods An integrative review methodology guided by Whittemore and Knalf was used. (...) Studies were identified by conducting searches on PubMed, Scopus, Web of Science, CINAHL, and LILACS databases. Of 2179 records, 34 studies matched the inclusion criteria. Results The main aspects involved in the practice of health advocacy by professional nurses are related to the ethical principles of the nursing profession, such as protecting patients seeking autonomy and care. Furthermore, the practice of health advocacy by nurses requires an empathetic attitude, responsibility, and assertive communication. Conclusion The diverse possibilities for the practice of advocacy synthesized in this study allow nurses to approach and become familiarized with the topic, being able to acquire and complement knowledge that will reflect on their professional practice in different work environments such as the educational field, in hospital practice, or basic health care. The statue and the lump of clay that constitutes it fail to share all of their kind and modal properties. Therefore, by Leibniz’s Law, the statue is not the lump. Question: What grounds the kind and modal differences between the statue and the lump? In virtue of what is it that the lump of clay, but not the statue, can survive being smashed? This is the grounding problem. Now a number of solutions to the grounding problem require that we substantially (...) revise our view of reality. In this paper, I provide a solution to this problem that does not require such a revision. I then show how my solution to the grounding problem can solve a related problem and answer a related question. The upshot is that the solution I offer is not only non-revisionary, but also fruitful. Tal análise se justifica em vista de Kant, no escrito sobre a religião, apresentar a definição da ação por dever e da ação moralmente má nos termos de hierarquia e ordem moral dos móbiles, formulação que, aparentemente, não é apresentada no âmbito da fundamentação da moral. It is my contention that there is a significant relationship between “Phenomenology of Perception” (Merleau-Ponty) and “The Second Sex” (de Beauvoir). The two authors give great importancc to the lived body (Leib), either from a neutral perspective, either from a perspective feminine. This key concept of the phenomenology allows us to understand the lived experience of women and their possible relationship with feminism. From this corporeal sense we analyze the Merleau-Pontinian redefinition of subjectivity and reason. We emphasize his criticism of (...) reductionism, both epistemological as ontological. We refute certain feminists accusations against Merleau-Ponty. To do this, we study all his work in search of traces of women, we place them in context, while we study his own hermeneutics of psychoanalysis in order to highlight the contribution of it to the deconstruction of stereotypes about femininity. We conclude by showing the main keys of this phenomenology for· the current feminist Philosophy. (shrink)

Merleau-Ponty como una fenomenología de la expresión ontológica, por considerar que reflexiona sobre algunos impensados de Husserl y los prolonga en una nueva ontología contribuyendo así, una vez más, a superar los dualismos heredados, en este caso, el que se produce entre fenomenología y ontología. Aunque haremos un recorrido por toda la obra merleau-pontiana, para pensar el sentir nos centraremos en la última, en la que el cuerpo vivido, pieza clave de la (...) rehabilitación ontológica de lo sensible, interacciona entre lo visible y lo invisible y la percepción se redefine como proceso que ocurre entre mi carne y la carne del mundo. Así veremos cómo Merleau-Ponty desarrolla la génesis y la síntesis pasiva explicitando el problema de· la estética transcendental, implícita en Husserl. Ésta se inicia con la reflexividad corporal y culmina en la reversibilidad siempre inminente de la carne. Two hundred years after it was first published, Mary Shelley’s Frankenstein; or, the modern Prometheus remains relevant. This novel has endured because of its literary merits and because its themes lend themselves to analysis from multiple viewpoints. Scholars from many disciplines have examined this work in relation to controversial scientific research. In this paper, we review the academic literature where Frankenstein is used to discuss ethics, bioethics, science, technology and medicine. We searched the academic literature and carried out a content (...) analysis of articles discussing the novel and films derived from it, analyzing the findings qualitatively and quantitatively. We recorded the following variables: year and language of publication, whether it referred to the novel or to a film, the academic discipline in which it was published, and the topics addressed in the analysis. Our findings indicate that the scientific literature on Frankenstein focuses mainly on science and the personality of the scientist rather than on the creature the scientist created or ethical aspects of his research. The scientist’s responsibility is central to the ethical interest of Frankenstein; this issue entails both the motivation underlying the scientist’s acts and the consequences of these acts. (shrink)

We study the origin of quantum probabilities as arising from non-Boolean propositional-operational structures. We apply the method developed by Cox to non distributive lattices and develop an alternative formulation of non-Kolmogorovian probability measures for quantum mechanics. By generalizing the method presented in previous works, we outline a general framework for the deduction of probabilities in general propositional structures represented by lattices (including the non-distributive case).

Although US and European research has documented improvement in earnings quality associated with corporate governance characteristics, the situation in Latin America is questionable, given the business environment in which firms operate, which is characterized by controlling family ownership and weak legal protection. The purpose of this study is to examine the relation between the internal mechanisms of Corporate Governance and Earnings Management measured by discretionary accrual. We use a sample of listed Latin American non-financial companies from the period 2006–2009. Our (...) results show how in the Latin American context the role of external directors is limited and that Boards which meet more frequently take a more active position in the monitoring of insiders, so showing a lower use of manipulative practices. In addition, we find a non-linear relation between insider ownership and discretionary accruals, also pointing to the fact that ownership concentration may be a manipulative practices constrictor mechanism only when the ownership of main shareholders is moderate. The findings have important policy implications since this is, to the best of our knowledge, the first study to analyze the relation between the effectiveness of the government and the earnings management behavior. As policy implications, we document how when a country implements controls aimed at reducing corruption, strengthening the rule of law or improving the effectiveness of government, this leads to a reduction in firm earnings management. The “phenomenology of existence” is one of the contemporary currents of philosophy which have developed taking existence as its central concern. The purpose of this article is to present my conception of this fundamental field of phenomenological research. In order to do this, I will analyze phenomenology of existence in the double sense of the genitive or better as a bidirectional phenomenological- existential movement; that is to say, on the one hand, I will explore the sense and scope of phenomenology (...) for existence and, on the other hand, the meaning of existence for the phenomenological existential movement. With the aim of describing this twofold dynamics, I will begin by clarifying certain concepts of the Husserlian method that have frequently either been ignored or misinterpreted and, therefore, have impeded us from understanding the meaning of what the founder of phenomenology called “personal existence.” After this elucidation that takes place at the static level of phenomenology, I will apply some key concepts of genetic phenomenology to existence in order to develop my own account of the existential phenomenology. Given that Maurice Merleau-Ponty (1908–1961) was a pioneer in the study of the most representative Husserlian texts dealing with the major issues of genetic phenomenology–such as time, space, lived body, intersubjectivity and lifeworld—, I will draw from his philosophy to open a dialogue with María Zambrano (1904–1991), as an example of the possibilities offered by a—comparative—phenomenology for the study of existential problems, specifically for the development of a phenomenology of sensing and being sensed that goes beyond of the paradigm of representation. BackgroundAdvances in biomedicine can substantially change human life. However, progress is not always followed by ethical reflection on its consequences or scientists’ responsibility for their creations. The humanities can help health sciences students learn to critically analyse these issues; in particular, literature can aid discussions about ethical principles in biomedical research. Mary Shelley’sFrankenstein; or, the modern Prometheus(1818) is an example of a classic novel presenting complex scenarios that could be used to stimulate discussion.Main textWithin the framework of the 200th anniversary (...) of the novel, we searched PubMed to identify works that explore and discuss its value in teaching health sciences. Our search yielded 56 articles, but only two of these reported empirical findings. Our analysis of these articles identified three main approaches to usingFrankensteinin teaching health sciences: discussing the relationship between literature and science, analysing ethical issues in biomedical research, and examining the importance of empathy and compassion in healthcare and research. After a critical discussion of the articles, we propose usingFrankensteinas a teaching tool to prompt students to critically analyse ethical aspects of scientific and technological progress, the need for compassion and empathy in medical research, and scientists’ responsibility for their discoveries.ConclusionFrankensteincan help students reflect on the personal and social limits of science, the connection between curiosity and scientific progress, and scientists’ responsibilities. Its potential usefulness in teaching derives from the interconnectedness of science, ethics, and compassion.Frankensteincan be a useful tool for analysing bioethical issues related to scientific and technological advances, such as artificial intelligence, genetic engineering, and cloning. Considerando a importância dos processos de formação continuada de profissionais da educação, objetiva-se analisar um movimento formativo de Gestores de Educação Especial no ano de 2020, durante a pandemia de Covid-19, por meio das funções mediadoras da relação teoria e prática, sustentada no referencial teórico de Habermas e os autores Carr e Kemmis. Realiza-se uma análise documental de cunho qualitativo do Grupo de Estudo-Reflexão: Gestão de Educação Especial enquanto processo formativo. Os grupos de estudo-reflexão estão alicerçados na pesquisa-ação e se (...) constituem como grupos autorreflexivos. Identifica-se a realização das funções por meio das ações formativas organizadas e implementadas em um movimento cíclico durante o período analisado, além disso, os dados apontam ganhos positivos quando se trata do desenvolvimento autorreflexivo e a emancipação dos sujeitos envolvidos foram vivenciadas as funções mediadoras da relação teoria e prática. A identificação das funções mediadoras se constitui como importante meio de averiguação das condições que tornam possíveis a geração de conhecimentos que sejam valorosos para as redes de ensino. Defende-se a necessidade de discutir, pensar e investir em formações críticas como forma de romper paradigmas instituídos no bojo de uma racionalidade instrumental. (shrink)

With the world grappling with continued spread of monkeypox internationally, vaccines play a crucial role in mitigating the harms from infection and preventing spread. However, countries with the greatest need - particularly historically endemic countries with the highest monkeypox case-fatality rates - are not able to acquire scarce vaccines. This is unjust, and requires rectification through equitable allocation of vaccines globally. We propose applying the Fair Priority Model for such allocation, which emphasizes three key principles: 1) preventing harm; 2) prioritizing (...) the disadvantaged; and 3) treating people with equal moral concern. Post-exposure prophylaxis (PEPV) has the most potential to mitigate harm, and so ensuring countries have sufficient supply for PEPV should be the first priority. And historically endemic countries, which face disadvantages that compound potential harms from monkeypox, should be the first recipients of such vaccines. Once sufficient supply is allocated for countries to apply PEPV, global allocation could move on to pre-exposure prophylaxis (PrEP), again prioritizing historically endemic countries first before distribution to the rest of the global community, based on projected number of cases and vulnerability to harm. In ‘Parental Virtues: A New Way of Thinking about the Morality of Reproductive Actions’ Rosalind McDougall proposes a virtue-based framework to assess the morality of child selection. Applying the virtue-based account to the selection of children with impairments does not lead, according to McDougall, to an unequivocal answer to the morality of selecting impaired children. In ‘Impairment, Flourishing, and the Moral Nature of Parenthood,’ she also applies the virtue-based account to the discussion of child selection, and claims that couples with (...) an impairment are morally justified in selecting a child with the same impairment. This claim, she maintains, reveals that the flourishing of a child should be understood as requiring environment-specific characteristics. I argue that McDougall's argument begs the question. More importantly, it does not do justice to virtue ethics. I also question to what extent a virtue ethics framework can be successfully applied to discussions about the moral permissibility of reproductive actions. (shrink)

Creemos que esta pregunta es fundamental si queremos valorar la pertinencia del debate contemporáneo acerca de los derechos animales, el Especismo y la ética ampliada. Partimos del debate respecto a la concepción de los animales en el debate Descartes-More, pues consideramos que gran parte de esa discusión sigue vigente nuestros días.

In this paper, I advance a lesser known counterfactual principle of grounding in a new kind of way by appealing to properties and the work they do. I then show that this new way of arguing for this principle is superior to another way, describe some of the work this principle can do, defend my use of this principle, and conclude with remarks on why principles like it are needed.

Truthmaker says that things, broadly construed, are the ontological grounds of truth and, therefore, that things make truths true. Recently, there have been a number of arguments purporting to show that if one embraces Truthmaker, then one ought to embrace Truthmaker Maximalism—the view that all non-analytic propositions have truthmakers. But then if one embraces Truthmaker, one ought to think that negative existentials have truthmakers. I argue that this is false. I begin by arguing that recent attempts by Ross Cameron and (...) Jonathan Schaffer to provide negative existentials with truthmakers fail. I then argue that the conditional—if one embraces Truthmaker, the one ought to embrace Truthmaker Maximalism—is false by considering worlds where very little, if anything at all, exists. The conclusion is that thinking that negative existentials do not have truthmakers, and therefore rejecting Truthmaker Maximalism, need not worry Truthmaker embracers. (shrink)

The key premise for this conclusion relies on a constraint on what, in certain cases, it takes for something to ground, or metaphysically explain, something else. In this essay we argue that attempts to justify the value of the liberal arts in narrowly instrumental ways are a mistake, one that is likely to miss the central importance of a liberal arts education. Of course, we do not claim here that such instrumental justifications are completely wrong, but that in so far as liberal education is defended primarily in terms of enhanced practical outcomes (better paying jobs, saleable professional skills, higher scores on graduate and professional admissions exams, (...) and so on) advocates will fail to articulate one of the most important reasons for study in the liberal arts. We will characterizeliberal education as a practice of reflecting on, discussing, and evaluating the question of what sort of lives I we should lead. Based on this, we then offer whatwe believe is a more promising, more consistent way of justifying liberal education. (shrink)

Courts play a key role in deciding on public health controversies, but the legitimacy of judicial intervention remains highly controversial. In this article I suggest that we need to carefully distinguish between different reasons for persistent disagreement in the domain of public health. Adjudicating between public health controversies rooted in factual disagreements allows us to investigate more closely the epistemic capacities of the judicial process. While the critics typically point out the lack of appropriate expertise of judges—in particular with respect (...) to health and public health—we should not move too fast in inferring from this a generalized competence problem. This article offers four reasons for vindicating the importance of judicial intervention in factual disagreements: the relative independence of judges from the political establishment, the judicial commitment to evidence, the specific nature of judicial reasoning and an additional voice for the people in the policy-making process. Paralelamente a nuestros propios estudios de las relaciones intersubjetivas, la temporalidad vivida, la identidad y la diferenciación, la dialéctica entre la memoria y el olvido, la esperanza y la finitud o el sueño, continuamos pensando estos fenómenos-límite desde (...) la fenomenología genética y generativa, concebida como una investigación retrospectiva que considera esencial para la constitución tanto la relación entre actividad y pasividad como entre el yo y los otros. El estudio de estos fenómenos, relegados generalmente a la literatura, desvelará finalmente el sentido de la reflexión fenomenológica literaria en clave intersubjetiva y repercutirá en una fenomenología de la alteridad.This article interprets crucial texts of Husserl and Merleau-Ponty by following to Iribarne, mainly Phenomenology and Literature, articulating the diversity of its issues around the explication of transcendental intersubjectivity, on which she never stopped thinking. In parallel to our own studies of the inter-relationships between the lived temporality, identity and differentiation, the dialectic between memory and forgetting, hope and finitude or the dream, I continue to think about these phenomena-limit from genetic and generative phenomenology conceived as a retrospective research that considers essential to constitution both the relationship between activity and passivity as between self and other. The study of these phenomena, usually relegated to literature, will reveal the phenomenological meaning of literary reflection as central to intersubjectivity and it will have implications for a phenomenology of alterity. One major objection to social rights is a failure of determining which precise social and economic claims should be granted rights status. The social rights debate has grappled with this ‘indeterminacy problem’ for quite some time, and a number of proposals have emerged aimed at fixing the content of these rights. In what follows I examine three distinct approaches to fleshing out the idea of a minimum threshold: social rights as the fulfilment of basic needs, social rights as the securing (...) of a minimally decent life and social rights as a requirement of citizenship. Each of these proposals progressively expands on what the minimum threshold of social rights requires and, conversely, what obligations they generate on part of the state. I will show that none of these approaches is entirely satisfactory and suggest that the social rights debate look elsewhere to determine its content. (shrink)

As it is presently employed, grounding permits grounding many things from one ground. In this paper, I show why this is a mistake by pushing for a uniqueness principle on grounding. After arguing in favor of this principle, I say something about it and kinds of grounding, discuss a similar principle, and consider its import on a formal feature of grounding, ontology, and ontological simplicity.

Dos preguntas articulan las reflexiones contenidas en el presente trabajo: ¿Cuál es el sentido de nuestra vida? y ¿qué sentidos produce el psicoanálisis? La yuxtaposición de ambos interrogantes no debe darnos la idea de que la respuesta a una sirve de fundamento a la otra. La vecindad tiene por objetivo aquí mostrar cómo el psicoanálisis elabora sentidos. La primera pregunta ha sido considerada por algunos como una pregunta sin respuesta. Sin embargo consideramos que la posibilidad de una respuesta depende del (...) contexto filosófico desde el cual se la plantea y lo que se entiende por sentido. ¿Qué tipo de ontología es la que hace posible esta pregunta? Este trabajo se propone hacer una contribución a la elaboración de tal ontología la cual se presentará fundamentalmente como una ontología social, no como regional sino entendida como filosofía primera. Para ello tomaremos como base las ontologías sociales que a partir de Heidegger y, apartándose de él, desarrollaron Jean-Luc Nancy (2006) y McGuire y Tuchanska (2000). Realizaremos un estudio comparativo entre estas ontologías y las ontologías científicas para mostrar la necesidad de una ontología filosófica que nos permita abordar la cuestión del sentido. En base a esta ontología abordaremos la posibilidad de responder a estas preguntas en los discursos de las teorías psicoanalítica de Freud y de Winnicott. (shrink)

This paper sets forth the findings of a research study undertaken in Chihuahua, Mexico. The length of stay of 1 866 employees in six maquiladora plants is analyzed across a maximum of 24 months. By drawing on discrete time hazard modeling, the research analyzes the extent to which work and nonwork factors contributed to employee length of stay in the late 1980s. It examines, in particular, the influence of position, cohort grouping, plant type, and demographic characteristics on employee duration in (...) the participating plants.The findings show that line operators at the peak of high employment turnover in the maquiladora industry remained employed for an average of 10 months. The study highlights important differences, for the results were not uniform across all maquiladora employees. There were variations in length of stay among employees of different types of plants, in different positions in the same company, different months of entry, and different migrant status. (shrink)

O presente ensaio propõe uma reflexão acerca dos limites, do poder e da natureza da linguagem representativa, confrontando-a com a lógica dos sistemas de crença e sugerindo aproximações e cruzamentos entre as noções de imagem (linguagem), aparição (superstição) e construção (representação).
